We make no warranties, express or implied, regarding:
Accuracy or completeness of content;
Availability or reliability of the Site;

9.1 TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MUSIC WORLD ENTERTAINMENT CORPORATION, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION:
Any direct, indirect, incidental, special, consequential, punitive, or exemplary damages;
Loss of data, revenue, or profits;
Issues arising from use or inability to use the Site
9.2 IN NO EVENT SHALL THE TOTAL, AGGREGATE LIABILITY OF THE INDEMNIFIED PARTIES TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED, IN THE AGGREGATE, THE GREATER OF: (A) THE TOTAL AMOUNTS, IF ANY, PAID BY YOU TO US IN CONNECTION WITH THE SITE DURING THE THREE (3) MONTHS IMMEDIATELY PRECEDING YOUR CLAIM; OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00 USD). SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CONSEQUENTIAL OR INCIDENTAL DAMAGES; IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
10. Indemnification; Dispute Resolution
10.1 You agree to indemnify, defend, and hold harmless Music World Entertainment Corporation, its officers, directors, employees, agents, affiliates, licensors, and partners (collectively, the "Indemnified Parties") from and against any and all claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to: (a) your use of or access to the Site; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) any content you submit or transmit through the Site; or (e) your violation of any third-party rights, including intellectual property rights.

You and Music World Entertainment Corporation agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site that cannot be resolved through good-faith informal negotiation within thirty (30) days shall be resolved exclusively by binding arbitration administered by JAMS (Judicial Arbitration and Mediation Services, "JAMS") in accordance with its then-current rules and procedures, with the seat of arbitration in Houston, Texas, rather than in court, except that either party may bring claims in small claims court if the claims qualify. Notwithstanding the foregoing, Music World Entertainment Corporation may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or confidential information without the requirement of posting a bond. THE PARTIES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. If any court or arbitrator determines that this class action waiver is void or unenforceable, the arbitration provisions shall be deemed null and void. You have the right to opt out of this arbitration agreement by sending written notice to info@musicworldent.com within thirty (30) days of your first use of the Site. This Section shall survive termination of these Terms.
